We act for expat clients both living in Spain and abroad. The 2º situation usually happens when our client lives abroad and the spouses is domiciled in Spain.

This qualifies our client from taking legal proceedings here. And vice versa, sometimes it is our client who lives in Spain and the spouse abroad.

In any of these two situations mentioned, it does not prevent our client from going to the Spanish Courts. In a divorce case, the Spanish Court has the power to issue enforceable orders relating to the assets of the husband and wife worldwide.  

How do we deal with clients who live abroad? (a very frequent situation)

First, if a face to face appointment in Spain might not be feasible, we would then take initial instructions by way of a telephone call or a Skype or Face-Time conference call. Further communications would usually be by email, telephone or Skype. We will always schedule calls for foreign clients, taking into account time zone differences.

When a breakdown of a marriage or relationship unfortunately happens, it is essential to consider the effect of such decision on the children, in order to minimize the impact, it has on them as much as possible. Depending on their age and maturity, it will be hard for them to understand the implications of such a decision.

Consequently, any decisions affecting your children must be carefully pondered, as they will have long term lasting implications on the welfare and happiness of the children. We have seen many cases of poorly drafted divorce settlements that originated terrible and costly legal disputes causing additional upset for many years. Invariably in these situations, the children were the most affected.
