VALUATION FEES MORTGAGE SPAIN

The Supreme Court has recently ruled on January 27th 2021 (Appeal Nº 1926/2018. Decision Nº 35/2021) that the valuation fees in mortgage loans must be paid by the bank, and not by the consumer.
With this landmark Judgment, all the financial consequences derived from the nullity of mortgage clauses that previously imposed on consumers the full costs of formalizing the mortgage loan’s expenses, have been now satisfactorily resolved by the Supreme Court in favor of the consumer.
Therefore, in case you might be affected and you might wish to submit a claim, as a preliminary step, remember that you would need to gather all the necessary paperwork evidence, such as the mortgage contract as well as all the invoices paid for the valuation, notary and land registry fees of the mortgage.
